Using the site is an agreement with McIntosh Systems LLC.

The site is operated by McIntosh Systems LLC, a limited liability company organized in and operating from Minnesota, United States ("McIntosh Systems," "we," "us"). By using the site you agree to these terms. If you do not agree, do not use the site.

These terms apply to visiting the site, reading its content, and using its contact and intake forms. They do not create a client relationship. A client relationship begins only when both sides sign an engagement contract, and that contract, not this page, governs the work, the fees, the data handling, and the liabilities of an engagement.

  • Probe, scan, or test the vulnerability of the site or break its security or authentication measures.
  • Overload the site or its forms with automated traffic, or try to get past the bot checks and the intake substance gate that exist to keep the forms and the discovery endpoint from being farmed.
  • Submit content that is unlawful, infringing, or deliberately false, or impersonate someone else in a form or email.
  • Scrape or reuse the content in a way section 03 does not permit.

We may restrict or block access that puts the site, its data, or other visitors at risk.

You can read and cite the site. You can't republish it as your own.

The text, design, code, diagrams, the McIntosh framework, and the other material on the site are owned by McIntosh Systems LLC or used with permission, and are protected by copyright and other rights. You may view it, share links to it, and quote it with attribution for ordinary reference.

You may not copy the site's content wholesale, present it as your own, or use it to build a competing offering, without our written permission. The McIntosh Systems name and marks are ours, and these terms do not grant a license to use them.

/ 04 · what you send us

Don't send secrets before there's a contract to protect them.

When you send us something through a form or by email, you confirm you are allowed to share it, and you let us use it to respond and to scope possible work. How we store and handle it is described in the privacy policy.

The forms are a first conversation, not a secure channel under an agreement. Please do not send confidential or regulated information, credentials, or anyone else's personal data before there is a signed contract or NDA in place to govern it. If you do send it anyway, we are not liable for it under these website terms.

The content is informational, and availability isn't guaranteed.

The site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.

To the fullest extent permitted by law, McIntosh Systems LLC and its members and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of your use of the site, even if we have been advised of the possibility. Our total liability for any claim relating to the site is limited to one hundred US dollars.

Nothing in these terms limits liability that cannot be limited under applicable law. This section is about the website. Liability under a paid engagement is set by that engagement's contract.

We're not responsible for sites we link to.

The site may link to third-party sites and tools we do not control. We link to them for convenience or reference, not as an endorsement, and we are not responsible for their content, their practices, or what happens once you leave. Their terms and privacy policies are their own.

These terms can change, and the date at the top says when.

We may update these terms as the site changes. When we do, we update the "last updated" date at the top of the page. Continuing to use the site after a change means you accept the revised terms. Material changes to how the forms handle your data will also show up in theprivacy policy.

Minnesota law governs, and Minnesota is the venue.

These terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws rules. Any dispute relating to the site or these terms will be brought in the state or federal courts located in Minnesota, and you consent to their jurisdiction.
